1. Scope and Subject Matter of the Contract

These Terms of Use govern the legal framework for the use of the digital platforms and services (hereinafter "Services") of PlattformDialog. The Services include the provision of technologies and infrastructure for communication and information exchange via the Internet.

The subject matter of the contract is exclusively the provision of the technical platform. We do not make any promises regarding the success or outcome of the customer's use.

2. Rights and Obligations of Users

The user undertakes to use the Services only within the framework of applicable laws. In particular, it is prohibited to distribute content that is illegal, offensive, or fraudulent.

• The user guarantees the accuracy of the information provided by them.
• The user is responsible for the security of their access credentials.
• Any commercial use of third-party platform content requires prior consent.

2.1 Content and Exchange

Users can exchange content via our platforms. The user grants PlattformDialog the non-exclusive right to store, reproduce, and make this content publicly accessible for the purpose of providing the service.

3. Liability Limitations

The liability of PlattformDialog is, to the extent permitted by law, limited to intent and gross negligence. For slight negligence, we are only liable in the event of a breach of essential contractual obligations (cardinal duties) and only for the typically foreseeable damage.

We assume no liability for:

• Interruptions in the availability of the services due to maintenance work or force majeure.
• Loss of data, unless this is due to intentional or grossly negligent behavior on our part.
• Content published by users on the platform.
• Direct or indirect economic benefits that the user fails to gain from using the services.

4. Contract Duration and Termination

The use of the basic services can be terminated at any time without notice. For chargeable additional services, the contract terms and notice periods specified in the respective service description apply.

PlattformDialog reserves the right to terminate contracts with users without notice in the event of violations of these Terms of Use and to block access.

5. Changes to the Terms

We reserve the right to change these Terms of Use. Users will be informed of material changes in a timely manner by email or through a clear notice on the platform. The amended terms are deemed accepted if the user does not object in writing within four weeks of notification and continues to use the services.

6. Final Provisions and Contact

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is, to the extent permitted by law, our registered office.
